UBISOFT “BAND TOGETHER WITH PETZ” SWEEPSTAKES

                                                                                           

 

 

 

I.  NAME OF SPONSOR

 

Radio Disney, a division of ABC Radio Networks Assets, LLC (hereinafter referred to as “Sponsor”), P.O. Box 802626, Dallas, TX 75380, whose decisions are final and binding as to all aspects of the Ubisoft “Band Together with Petz” sweepstakes (“Sweepstakes”).

 

II.  ELIGIBILITY 

 

The Sweepstakes is open to children ages 6 through 13, who are legal residents of, and physically located within, the 50 United States or D.C., except Maine (“Territory”).

 

Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for Radio Disney, a division of ABC Radio Networks Assets, LLC, Radio Disney Group, LLC, Ubisoft Entertainment, any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes or supplying the prize, and/or their respective parent, subsidiary, affiliated and successor companies; (individually and collectively, “Entities”), members of their households and immediate families and any person who, within the past six months, has been awarded a Grand Prize in any sweepstakes conducted by Sponsor, are not eligible to enter or play.  "Immediate family members” shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses.  “Household members” shall mean people who share the same residence at least three months a year.

 

III.  HOW AND WHEN TO ENTER

 

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE IMPROVE ONE’S CHANCES OF WINNING

 

On-line Entry:  During the period commencing at 12:00:01 A.M., November 16, 2009, and ending at 11:59:59 P.M., December 12, 2009 (“Term”), the Sweepstakes may only be entered On-line by a registered Disney.com guest (“Member”).  For purposes of these Official Rules (“Rules”), all times are Pacific Standard Time and “Day” shall mean a calendar day during the Term.  A registered Member may enter by going directly to www.disneyxd.com/petz (“Website”) and clicking on the “Enter Now” button.  You will be asked to Log In with the Member Name and Password that was set up when you registered and to click on the “Submit” button which will result in one (1) Entry to be entered into the Sweepstakes to win a Grand Prize.  If you are not already a Member, you may easily register to become a Member for free through the link on the site:  “Register” by filling out the simple Registration Form.  Upon becoming a Member by registration, you may enter the Sweepstakes by following the above instructions.  Normal internet access and usage charges imposed by your online service will apply.  It is your sole responsibility to notify Sponsor if you change the Address.  To do so, go to http://register.go.com/disney/GuestServices/YourAccount/login, log into your Membership Account, click on the “Modify” icon and follow the instructions on how to change the Address.

 

During the Term, all Radio Disney and Radio Disney affiliated stations will promote, by means of on-air commercial spots, the opportunity to win the Grand Prize described below.  New radio stations may be added at any time during the Term, as they become participating Radio Disney affiliates.

 

All Entries must be received by 11:59:59 P.M., December 12, 2009.  Regardless of whether one person has more than one E-mail Address or more than one person use the same E-mail Address, only one (1) Entry per person per Day is permitted (a maximum of twenty-seven (27) per Entrant during the Term).

 

Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, “Releasees”) are responsible for Entries from persons residing, or physically located, outside the Territory; Entries that are altered, delayed, deleted, destroyed, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, late, lost, misrouted, non-delivered, stolen, tampered with, unauthorized or unintelligible; or any printing, production, technical, electronic or other errors; or for technical failures of any kind, including but not limited to:  electronic malfunction or damage of any network, hardware or software; lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable e-mails resulting from any form of active or passive e-mail filtering; insufficient space in entrant’s e-mail account to receive e-mail; or other errors of any kind, whether due to electronic, mechanical or human error or other causes; even if caused by the negligence of any of the Releasees.  Each of such potential Entries will be disqualified.  Void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations.  In the event of a dispute regarding the identity of the person submitting an Entry, it will be deemed to be submitted by the person in whose name the E-mail Address is registered.

 

Entrant's Personal Information: The personal information submitted to the Sweepstakes will be used by Sponsor.  Sponsor will use that information in accordance with their privacy policy posted at http://disney.go.com/corporate/privacy/pp_wdig.html.You should review Sponsor’s privacy policy to learn how your information may be used.

 

 

 

 

IV.  HOW AND WHEN A WINNER WILL BE SELECTED AND NOTIFIED 

 

On or about December 14, 2009, one (1) Grand Prize Winner (“Grand Prize Winner”) and one-hundred (100) First Prize Winners (“First Prize Winners”) will be selected at random from all eligible Entries received. 

 

Winners must meet all eligibility requirements.  In the event a Winner is deemed ineligible, or is not available to claim prize during specified dates, then an alternate winner will be selected at random from eligible entries received, time permitting. 

 

The Winners will be notified by phone and / or e-mail on or about December 14, 2009; and will receive an Affidavit of eligibility/compliance with Rules, publicity/liability release and indemnification via mail within five (5) days of notification.  All legal responsibilities of a minor under the Rules will be assumed by a Parent.  Winner will be required to provide satisfactory proof to Sponsor of his/her age, identity and residency.  Response to mail notification must be received by Sponsor within seven (7) business days or the prize will be forfeited and may be awarded to an alternate winner, time permitting.

 

Odds of winning depend on the total number of eligible Sweepstakes Entries received.  Many will enter; only one-hundred-one (101) will win.

 

V.  PRIZE(S)

 

ONE (1) GRAND PRIZE:  If you are the winner (“Grand Prize Winner”), you will receive a three (3) day / two (2) night trip for four persons (Winner, one Parent/Legal Guardian, and two other guests) (“Family”) to Los Angeles, CA (“City”) to visit the Radio Disney Studio (“Radio Disney Studio”) and play Ubisoft Petz video games (“Video Games”) with Honor Society (“Artists”).  The Grand Prize consists of the following elements:  [1] hotel accommodations for two (2) nights (one standard room, quadruple occupancy) at a Sponsor selected hotel in the City; [2] three (3) Video Games, including Ubisoft’s Petz Nursery for Nintendo DS, Petz Dogz Talent Show for Nintendo DS, and Petz Hamsterz Superstarz for Nintendo DS games; [3] one (1) meet and greet for the Family with the Artists at the Radio Disney Studio and an opportunity to play the Video Games with the Artists; [4] if the Winner resides more than 250 miles from the City, round-trip coach air transportation for the Family between an airport near the Winner’s residence (“airport of origin”) and an airport near the City; and [5] round trip airport / hotel / Radio Disney Studio transfers in the City; [6] $500 spending money.  There are no other prizes.  All expenses not specifically mentioned herein are not included and are solely the Winner’s responsibility, including but not limited to: round-trip transportation between the Winner’s residence and any airport of origin, room service, laundry service, meals, alcoholic beverages, merchandise, souvenirs, telephone calls, tips, gratuities and service charges.  Airline carrier and hotel regulations and conditions apply.  Travel and lodging are subject to availability, certain restrictions, blackout dates and Sponsor’s approval.  Family must travel on same itinerary and must be available to travel on dates as approved by Sponsor.  Trip must be completed between February 1, 2010 – February 28, 2010.  Approximate Retail Value of Grand Prize: $3,000. ONE HUNDRED (100) FIRST PRIZE WINNERS:  If you are a First Prize Winner (“First Prize Winner”), you will receive one (1) Ubisoft Petz Nursery Game valued at $30.  Total ARV of 100 First Prizes:  $3,000.  The prizes will be awarded provided they are validly claimed by January 8, 2010, after which alternate winners will be selected at random from the remaining eligible entries received.

 

Approximate retail value (“ARV”) of all prizes is $6,000.

 

All expenses not specifically provided for herein are the winner’s sole responsibility. 

 

Federal, state and local taxes, if any, are the sole responsibility of the Winner, who will receive an IRS Form 1099 reflecting the final actual value of any prize valued at $600 or more.

 

Winners are not entitled to exchange or transfer the prize or to obtain cash or other substitutes, but Sponsors in their sole discretion may substitute a prize of equal or greater value.

 

Prizes are subject to availability.  Sponsors are not responsible for any unavailability of the Artists or for other circumstances that make it impractical or impossible to fulfill this element of the Grand Prize; this element has no approximate retail value and if it becomes impractical or impossible to fulfill this element, Sponsors only obligation will be to provide the remaining elements, if any, of the prize.

 

 

VI.  RELEASES

 

By participating, entrants agree to be bound by these official rules and the decisions of the Sponsor and the Sweepstakes administrator, which shall be final in all respects.

By participating in this Sweepstakes and/or accepting any prize that they may win, entrants agree to release Radio Disney, a

division of ABC Radio Networks Assets, LLC (“Radio Disney”), Ubisoft Entertainment,  their parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all actions, claims, injury, death, loss or damage arising in any manner, directly or indirectly,

from participation in this Sweepstakes and/or acceptance or use of any prize.

 

Entrants authorize Sponsor to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, in any media now known or hereafter created or conceived, worldwide in perpetuity, or on a winner’s list, if applicable, without further compensation unless prohibited by law.  Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation.

 

To claim a prize, winner and/or winner’s parent or guardian must: (a) provide proof of winner’s age, residency, and legal status; (b) sign and return eligibility, publicity, liability and any other releases requested by Sponsor; and (c) have winner’s intended guest(s) or travel companion(s), if any, sign and return releases requested by Sponsor; all within the time period(s) specified by Sponsor.

 

VII.  MISCELLANEOUS; WINNERS’ LIST

 

Void where prohibited.  All federal, state and local laws and regulations apply.

 

Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify and/or suspend the contest in the event of tampering or other circumstances, including but not limited to acts of God or civil disturbance that render it impractical or impossible to complete or fulfill the contest as originally planned.
